Expert Witness

Expert witness reports for housing disrepair, housing conditions, and property licensing matters

“The duty of an expert witness is to help the court to achieve the overriding objective by giving opinion which is objective and unbiased, in relation to matters within their expertise. This is a duty that is owed to the court and overrides any obligation to the party from whom the expert is receiving instructions”.

Civil Proceedings

We provide expert evidence in Civil Litigation, specifically related to Housing Disrepair and Housing Condition disputes.

Our expertise covers the Landlord & Tenant Act 1985 Sections 9a, 9b, 10, and 11 (LTA 1985 S9a, S9b, S10 & S11), the Homes (Fitness for Human Habitation) Act 2018, and the Health and Safety Rating System (HHSRS).

Criminal Proceedings

We also provide expert evidence in criminal proceedings relating to housing standards and property licensing, where matters such as, but not limited to, unlicensed HMOs, housing conditions and breaches of the Housing Act are increasingly dealt with through the criminal courts. Our expertise covers offences under the Housing Act 2004, including operating an unlicensed HMO, operating an unlicensed property under a selective licensing scheme, breaches of the Management of Houses in Multiple Occupation Regulations, and failure to comply with improvement notices and prohibition orders, supported by assessments under the Housing Health and Safety Rating System.
